These Terms and Conditions of Service (the “Terms”) are an agreement between Blue Castle Waste Solutions, LLC (“Blue Castle,” “BCW,” “we,” “us,” or “our”) and the customer enrolling in service (“Customer,” “you,” or “your”). They apply to all solid waste collection, recycling, disposal, container rental, and related services we provide to you (the “Services”). Please read these Terms carefully. By checking the box and completing enrollment on our website, or by accepting service from us, you agree to these Terms.

1.1 Your Agreement. Your agreement with Blue Castle consists of these Terms together with the service level, collection frequency, container size, rates, and fees you selected and that are shown in your enrollment confirmation (your “Service Confirmation”). Your Service Confirmation and our current Schedule of Charges are part of these Terms.
1.2 Electronic Signature. You agree that checking the acceptance box and submitting your enrollment online is your electronic signature and has the same legal effect as a handwritten signature. You consent to receive these Terms, invoices, notices, and other communications electronically at the email address you provide. You may request a paper copy at any time by contacting us.
1.3 Authority. If you enroll on behalf of a business, organization, or other entity, you represent that you are authorized to bind that entity to these Terms. If you are not so authorized, you agree to be personally bound. If you enroll as an individual, you represent that you are at least 18 years old and are the owner, tenant, or authorized occupant of the Service Address.
1.4 Eligibility and Service Start. Service is available only at addresses within our service area. We may verify your address, collection site, and account information, and we may decline or cancel any enrollment before service begins. Your service begins on the start date stated in your Service Confirmation (the “Service Start Date”).
3.1 What We Provide. Blue Castle will collect, transport, recycle, and/or dispose of Acceptable Waste (defined in Section 6) from your Service Address at the frequency and service level you selected, and will provide the Equipment needed for that service.
3.2 Recycling. If your service includes recycling, we accept the materials listed on our website, which currently include clean cardboard, aluminum cans, and plastic bottles. Recyclables must be empty, reasonably clean, and free of food, liquids, and trash. We may change the list of accepted recyclables based on market conditions and processing availability.
3.3 Exclusive Service (Commercial Accounts). During the term of a Commercial Account, Blue Castle has the exclusive right to collect and dispose of Acceptable Waste from the Service Address for the service types you have selected. If you are under contract with another hauler, these Terms take effect once that contract has ended, and you are responsible for properly terminating it.
4.1 Residential Accounts. Residential service has an initial term of twelve (12) months beginning on the Service Start Date. After the initial term, it automatically renews for successive twelve (12)-month terms unless you or we give written notice of non-renewal at least ninety (90) days before the end of the current term. We will remind you of your upcoming renewal date before it occurs.
4.2 Commercial Accounts. Commercial service has an initial term of thirty-six (36) months beginning on the Service Start Date. After the initial term, it automatically renews for successive twelve (12)-month terms unless either party gives written notice of non-renewal at least ninety (90) days before the end of the current term.
4.3 Temporary Roll-Off Service. Temporary roll-off service is provided per rental, on a month-to-month basis, and is not subject to a minimum term.
5.1 Cancelling a Residential Account. You may end residential service at the end of its current term by giving written notice of non-renewal at least ninety (90) days before the end of the term, as described in Section 5.4. If you cancel before the end of the current term, the early termination fee in Section 5.6 applies. Any prepaid amounts for periods after service ends will be refunded, less any early termination fee and other amounts you owe us.
5.2 Moving Away (Residential Accounts). If you are moving away from the Service Address, you may cancel your Residential Account at any time by giving us at least thirty (30) days’ written notice as described in Section 5.4. No early termination fee will apply. Please include your move-out date and a forwarding address for your final bill and any refund.
5.3 Ending a Commercial Account. A Commercial Account may be ended at the end of its current term by written notice of non-renewal as described in Section 4.2. If you cancel before the end of the current term, the early termination fee in Section 5.7 applies.
5.4 How to Give Notice. Notice of cancellation or non-renewal must be in writing and sent by email to info@BlueCastleWaste.com or by certified mail to the address in Section 21. Please include your name, account number, and Service Address. Notice is effective when we receive it, and we will confirm receipt by email.
5.5 Termination by Blue Castle. We may suspend or terminate service, with notice to you, if: (a) your account is past due; (b) you place Excluded Waste in our Equipment or otherwise materially breach these Terms; (c) conditions at the Service Address are unsafe for our employees or vehicles; (d) the Service Address is no longer within our service area; or (e) we are required to do so by law or by a governmental authority.
5.6 Early Termination (Residential Accounts). If you cancel a Residential Account before the end of its current term, other than as permitted by these Terms, or we terminate it because of your breach, you agree to pay an early termination fee equal to three (3) months of your current monthly service charge, or the charges remaining in the current term, whichever is less.
5.7 Early Termination (Commercial Accounts). If a Commercial Account is cancelled by you before the end of its current term, other than as permitted by these Terms, or is terminated by us because of your breach, you agree to pay Blue Castle, as liquidated damages, an amount equal to your average monthly charges over the most recent twelve (12) months multiplied by six (6), or multiplied by the number of months remaining in the current term, whichever is less. If you have received service for fewer than twelve months, your most recent monthly charge will be used instead of the average. You acknowledge that our actual damages from early termination would be difficult to determine, and that this amount is a reasonable estimate of those damages and not a penalty.
5.8 Effect of Termination. When service ends, you must allow us access to remove our Equipment. You remain responsible for all charges incurred through the end of service, any amounts owed for lost or damaged Equipment, and any applicable fees under these Terms.
6.1 Acceptable Waste. “Acceptable Waste” means ordinary, non-hazardous solid waste generated at the Service Address and, if applicable to your service, accepted recyclables.
6.2 Excluded Waste. You may not place any of the following in our Equipment (“Excluded Waste”):
Some of these items may be collected by special arrangement for an additional fee. Please contact us before setting them out.
6.3 Refusal and Contamination. We may refuse to collect any container that holds Excluded Waste, is overloaded, or (for recycling) is contaminated with non-recyclable materials. We may leave the container uncollected, collect it as trash at your trash rate, and/or charge a contamination or special-handling fee as listed in the Schedule of Charges.
6.4 Title and Responsibility. Title to Acceptable Waste passes to Blue Castle when it is loaded into our vehicle. Blue Castle never takes title to Excluded Waste, which remains your property and responsibility. You agree to defend, indemnify, and hold harmless Blue Castle from all damages, penalties, fines, cleanup costs, and liabilities arising from any Excluded Waste you place in our Equipment or attempt to have us collect.
7.1 Ownership. All Equipment we provide remains the property of Blue Castle. You may use it only at the Service Address and only for its intended purpose.
7.2 Care of Equipment. You agree to use your best efforts to protect the Equipment from damage, theft, and loss while it is at the Service Address. If any Equipment is damaged (other than normal wear and tear or damage caused by our handling during service), stolen, or lost, you agree to reimburse Blue Castle for its replacement cost. You may not overload, move (other than rolling carts to and from the curb), paint, alter, or make improvements to the Equipment. Replacement costs are listed in the Schedule of Charges.
7.3 Site Conditions. You confirm that the area where our vehicles will travel and where Equipment will be placed can support the weight of our trucks and containers. Blue Castle is not responsible for damage to pavement, curbing, driveways, lawns, or other driving surfaces resulting from our normal servicing of the area you designated, except to the extent caused by our negligence.
7.4 Commercial Equipment. For Commercial Accounts, you are responsible for injury to persons or damage to property arising from the use, operation, or possession of the Equipment while at the Service Address, except to the extent caused by Blue Castle’s negligence or willful misconduct. You must keep dumpster lids and doors closed and locked if locks are provided, and keep the area around the Equipment clear.
7.5 Container Safety. Containers are dangerous to enter or climb. At no time may you or anyone else crawl, walk, stand, or sleep inside a container, or climb or jump on top of one. Please keep children away from containers and from our trucks during service. If you or anyone else is injured or harmed as a result of entering, climbing, or jumping on a container, you agree to defend, indemnify, and hold harmless Blue Castle from all resulting claims, damages, and liabilities, to the fullest extent permitted by law.
8.1 Residential Set-Out. Carts must be at the curb by 6:00 a.m. on your collection day; for best results, set them out the night before. Carts should have lids closed, handles facing your home, and at least three (3) feet of clearance from other carts, vehicles, mailboxes, and obstructions. Waste must be bagged and fit inside the cart with the lid closed. Extra bags or bulky items outside the cart will be collected only if you have arranged an extra pickup, and will be charged as listed in the Schedule of Charges.
8.2 Access. On collection day you must provide unobstructed access to the Equipment. If the Equipment is blocked, locked, or otherwise inaccessible, we will notify you, and any return trip or additional attempt will be charged as an extra pickup. You may also be charged for service changes caused by your failure to provide access.
8.3 Schedule Changes. Collection may be delayed or rescheduled because of holidays, severe weather, road conditions, equipment breakdowns, or other circumstances. We will make reasonable efforts to notify you of schedule changes by email, text, or on our website, and will resume service as soon as practicable. Missed collections caused by these conditions are not grounds for a credit unless we fail to make up the service within a reasonable time.
8.4 Missed Pickups. If we miss a scheduled pickup that was properly set out, please notify us within two (2) business days and we will collect it as soon as practicable at no additional charge.
9.1 Charges. You agree to pay for the Services according to the Schedule of Charges in effect at the time. You are also responsible for all taxes, fees, and surcharges imposed by federal, state, or local authorities on the collection or disposal of your waste.
9.2 Billing. Residential customers may choose to be billed monthly, quarterly, or annually in advance; quarterly and annual billing may qualify for a discount, as shown in the Schedule of Charges. Commercial service is billed monthly in advance. Additional charges, such as extra pickups, overweight fees, contamination fees, and roll-off charges, are billed after they are incurred.
9.3 Container Fill Levels. Your service charge is based on containers filled appropriately, with all waste inside and the lid fully closed. If a container is overflowing, its lid will not close, or bags or waste are piled on top of or beside it, we may collect the excess and charge an extra fee, as listed in the Schedule of Charges, or leave the excess for you to remove.
9.4 Automatic Payment Authorization. When you enroll online, you authorize Blue Castle and its payment processor to charge the credit card, debit card, or bank account you provide for all recurring service charges and any additional charges under these Terms, on each billing date and when additional charges are incurred, until you cancel service and all amounts are paid. You agree to keep your payment information current. If a payment fails, we may retry the charge and notify you. You may update your payment method or cancel this authorization by contacting us, but cancelling the authorization does not cancel your service or relieve you of amounts owed.
9.5 Invoiced Commercial Accounts. If we agree to invoice a Commercial Account, payment is due within ten (10) days after you receive the invoice.
9.6 Late Payments. Past-due balances are subject to a late fee of 1.5% per month, or the maximum rate permitted by law if lower. Returned or declined payments are subject to a fee of $25. If your account is more than 45 days past due, we may suspend service until the balance is paid, and a reinstatement fee of $50 may apply. For Commercial Accounts, we may also terminate service and recover our Equipment. Suspension does not relieve you of charges owed for the remainder of any term.
9.7 Collections. If any balance is more than ninety (90) days past due, Blue Castle is authorized to refer the past-due balance to a third-party collection agency to recover it. To the extent permitted by law, you agree to pay all costs of collecting past-due amounts, including the collection agency’s fee and reasonable attorneys’ fees, which will be added to your balance.
9.8 Billing Disputes. If you believe a charge is incorrect, please contact us within 30 days of the billing date. We will review it promptly and issue a credit or refund for any error.
10.1 Reasons for Adjustment. Some costs of providing the Services are beyond Blue Castle’s control and can significantly affect our operating expenses, including fuel, labor, and landfill and disposal fees. When these costs change, Blue Castle may need to adjust its rates. Blue Castle may adjust its rates and fees to reflect increases in disposal or landfill costs, transportation costs, fuel prices, recycling processing costs, taxes and government fees, and other operating costs of providing the Services. We may also apply a fuel and/or environmental surcharge, as shown in the Schedule of Charges.
10.2 Residential Accounts. We will give you at least 30 days’ notice of any rate increase by email or on your bill. If you do not agree with the increase, you may cancel service before it takes effect without any fee.
10.3 Commercial Accounts. We will make reasonable efforts to notify you in advance of rate adjustments. Your continued acceptance of service and payment of the adjusted rates constitutes your acceptance of them.
You may request changes to your service level, container size, or collection frequency by emailing info@BlueCastleWaste.com. Please include your name, account number, Service Address, and the change you would like. Changes take effect on the date we confirm, and your charges will be adjusted accordingly. Changes to a Commercial Account do not change its term unless we agree in writing.
12.1 Rental and Tonnage. Roll-off rentals include the rental period and disposal tonnage stated in your Service Confirmation. Additional rental days, additional tonnage, trip charges, and relocation fees are billed as listed in the Schedule of Charges.
12.2 Placement and Permits. You must designate a placement location that is level, accessible, and able to support the container and our truck. If the container will be placed on a street or other public property, you are responsible for obtaining any required permits. If a municipality or other governmental authority issues a ticket, citation, or fine because of where the container is placed, you agree to reimburse Blue Castle for the full amount.
12.3 Overweight Containers. You may not load a roll-off container above its rated capacity or above its rim. If a container cannot be safely or legally transported, you must remove excess material before we haul it, or pay a return-trip charge. If any government authority fines Blue Castle because a container you loaded was overweight, you agree to reimburse us for that fine.
12.4 Concrete, Dirt, and Heavy Materials. If you plan to load a container with concrete, brick, rock, dirt, soil, or other heavy debris, please tell us when you place your order so we can provide a container sized for heavy loads. Heavy materials loaded into a container not designated for them may result in overweight charges, a return-trip charge, or our refusal to haul the container until the excess is removed.
Blue Castle is not responsible for delays or failures to provide service caused by events beyond our reasonable control, including severe weather, natural disasters, road closures, fires, labor disputes, disposal facility closures, fuel shortages, governmental actions, pandemics, or acts of God. Service will resume as soon as reasonably practicable.
14.1 Limits on Damages. To the fullest extent permitted by law, Blue Castle is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to the Services or these Terms. Except for liability arising from our gross negligence or willful misconduct, our total liability to you for any claim related to the Services will not exceed the amount you paid us for the Services during the three (3) months before the claim arose. Nothing in these Terms limits any right you have under law that cannot be waived.
14.2 Container Placement and Clearance. You agree to place the Equipment, or designate a location for it, in an area our trucks can reach and service safely, with ample clearance from structures, vehicles, and overhead obstructions. If any property, structure, or vehicle is damaged as a result of inadequate clearance or an unsafe placement location, including damage to grass, landscaping, curbs, driveways, pavement, vehicles, overhangs, canopies, and low-hanging wires, you agree to indemnify and hold harmless Blue Castle from all resulting claims, damages, and costs, except to the extent caused by Blue Castle’s gross negligence or willful misconduct.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Blue Castle and its owners, employees, and agents from all claims, damages, suits, penalties, fines, and liabilities, including reasonable attorneys’ fees, arising from (a) your breach of these Terms; (b) any Excluded Waste you place in our Equipment; or (c) the negligent acts, omissions, or willful misconduct of you or your employees, agents, tenants, or contractors.
By enrolling, you agree that we may contact you by email, phone, and text message at the contact information you provide about your account, service changes, schedule updates, billing, and payment. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and you may unsubscribe from marketing emails at any time. Our collection and use of your personal information is described in our Privacy Policy at bluecastlewaste.com/privacy-policy/.
17.1 Definition. A “Change of Control” means (a) a sale, transfer, or other disposition of more than fifty percent (50%) of the ownership interests or voting power of a party, whether in one transaction or a series of related transactions; (b) a merger, consolidation, or reorganization after which the owners of a party immediately before the transaction own less than fifty percent (50%) of the surviving entity; or (c) a sale or transfer of all or substantially all of a party’s assets or of the business operations at the Service Address. For a Residential Account, a sale or transfer of the home at the Service Address is treated as a Change of Control.
17.2 Change of Control of Blue Castle. If Blue Castle undergoes a Change of Control, these Terms and your account will transfer to and remain binding on the new controlling owner or successor, without notice to you.
17.3 Transfer if Blue Castle Leaves Your Area. If Blue Castle stops providing service in the area that includes your Service Address, you and Blue Castle agree that Blue Castle may assign these Terms and your account to another solid waste collection provider, without notice to you. The new provider will be bound by these Terms and will provide the Services in place of Blue Castle.
17.4 Change of Control of a Commercial Customer. If a Commercial Account customer undergoes a Change of Control, these Terms will transfer to and bind the new controlling owner for the remainder of the current term. You agree to notify Blue Castle promptly, and to provide the new owner’s contact and updated billing information.
17.5 Sale of a Residential Home. If you sell the home at the Service Address and have not cancelled under Section 5.2, these Terms will transfer to the new property owner for the remainder of the current term. You agree to notify Blue Castle before closing and to provide the new owner’s contact and updated billing information. You remain responsible for all charges through the date of transfer.
17.6 Other Assignments. Except as provided in this Section, you may not assign or transfer your account without our written consent. Blue Castle may assign these Terms, in whole or in part, to an affiliate or to any successor to all or part of its business without your consent. These Terms are binding on you and Blue Castle and on our respective heirs, successors, and permitted assigns.
18.1 Informal Resolution First. Before starting arbitration or any other proceeding, the party with a dispute agrees to send the other a written description of the dispute and the relief requested. Notices to Blue Castle should be sent to info@BlueCastleWaste.com or to the mailing address in Section 21. You and Blue Castle agree to try in good faith to resolve the dispute informally for at least sixty (60) days after the notice is received.
18.2 Binding Arbitration. If the dispute is not resolved within that sixty (60)-day period, you and Blue Castle agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration rather than in court. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules for Residential Accounts and its Commercial Arbitration Rules for Commercial Accounts, before a single arbitrator. The arbitration will take place in the county where the Service Address is located, or by phone or video if both parties agree. Arbitration fees will be paid as provided in the applicable AAA rules. The arbitrator’s decision is final, and judgment on the award may be entered in any court with jurisdiction. YOU AND BLUE CASTLE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JUDGE OR JURY.
18.3 Class Action Waiver. You and Blue Castle agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action or proceeding. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to resolve that party’s individual claim. Unless you and Blue Castle both agree otherwise in writing, the arbitrator may not consolidate the claims of more than one person or preside over any form of class, collective, or representative proceeding. YOU AND BLUE CASTLE ARE EACH WAIVING THE RIGHT TO PARTICIPATE IN A CLASS ACTION. If a court decides that this class action waiver is unenforceable as to a particular claim, then that claim (and only that claim) will be severed from the arbitration and decided in court, and all other claims will remain in arbitration.
18.4 Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Blue Castle may also refer past-due balances to a collection agency under Section 9.7 without first going through arbitration.
18.5 Governing Law. These Terms are governed by the Federal Arbitration Act and, otherwise, by the laws of the state in which your Service Address is located, without regard to its conflict-of-law rules.
We may update these Terms from time to time. The current version, with its “Last updated” date, will always be posted on our website. If we make a material change that adversely affects you, we will notify you by email or on your bill at least 30 days before it takes effect. Residential customers who do not agree may cancel without fee before the change takes effect. Your continued use of the Services after a change takes effect means you accept the updated Terms. Changes do not apply retroactively.
20.1 Entire Agreement. These Terms, your Service Confirmation, and the Schedule of Charges are the entire agreement between you and Blue Castle regarding the Services and replace any prior agreements or understandings about them. If there is a conflict, your Service Confirmation controls, followed by these Terms.
20.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full effect.
20.3 No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
20.4 Notices. We may send notices to the email or mailing address on your account. Notices to Blue Castle should be sent to the contact information below. Notices of cancellation or non-renewal must be given as described in Section 5.4.
